ETIAS with limited validity: the emergency route explained

A few travellers who are refused ETIAS may still be allowed in for a funeral, a court date or urgent medical care. Here is who can ask, what it covers and what it does not.

An ETIAS travel authorisation with limited validity is the EU’s exceptional route for someone who must travel for humanitarian reasons or to meet an important obligation, and whose ordinary ETIAS has been refused, annulled or revoked, or is not expected to be accepted. It is not a fast lane and it is not a right. The country you want to visit decides, it covers only the countries named on it, and it lasts up to 90 days from your first entry. ETIAS is not yet in operation, so nobody can request one today.

When can you ask for ETIAS with limited validity?

The official ETIAS portal says you may request one if you meet both conditions: you need to travel “due to humanitarian reasons or in order to fulfil important obligations”, and you expect that your ETIAS application may not be accepted, or your authorisation has already been refused, annulled or revoked.

The legal basis is Article 44 of the ETIAS Regulation (EU) 2018/1240. It allows a country to issue one “exceptionally”, on humanitarian grounds under its national law, for reasons of national interest or because of international obligations. The same article covers a second case: a country can issue one, once the application is admissible, while manual processing of your application is still unfinished, and that does not stop the normal application being processed.

What counts as a good reason?

The portal gives examples of circumstances the authorities may take into account. They are:

  • life-threatening illness of the applicant or close relatives
  • attending the funeral of an ascending or descending family member
  • urgent medical cases
  • taking part in inter-governmental conferences
  • an obligation to appear in court
  • granting of rights of transit with temporary stay

These are examples, not a checklist that guarantees a yes. The portal is explicit that the decision “lies exclusively with the authorities of the countries requiring ETIAS”, and the authorities may ask for extra information or documents before they decide. A holiday, a business meeting you would like to keep or a booked flight is not the kind of reason the route exists for.

Where can you travel with it?

Only to the countries named on the authorisation. The portal says that, unlike a standard ETIAS, it does not cover all 30 European countries requiring ETIAS. Article 44 adds that these authorisations are generally valid only in the territory of the issuing country. A wider one covering several countries needs the consent of each of them.

The portal says the length is set by the national authorities, up to a maximum of 90 days from the moment you enter the countries it was issued for, and that you can use it for multiple entries. Article 44 words the same cap as 90 days from the date of first entry. If you are later issued a normal ETIAS valid for every ETIAS country, the limited one expires.

How do you request it?

Under the portal’s description, you ask after you have submitted an ETIAS application. You give the reasons, humanitarian grounds or important obligations, and name the countries you need to visit. The regulation points to the public website and app for the contact step, and says you quote your application number, the country you intend to travel to and the nature of your reason. The ETIAS Central Unit then passes this to the national unit of that country.

You get the outcome by email. If it is granted, the email states the start and end dates and the countries you may enter. If it is refused, the portal says you have the right to appeal; our explainer on ETIAS refusals and appeals covers that route.

What does it not change?

  • It is not an application route today. The portal states that ETIAS is “currently not in operation” and that no applications are collected. The EU says it will announce the start date several months before launch, and no official date exists. Press reporting points to 2027.
  • It does not wipe the record. Article 44 says these authorisations can still carry a flag for border officers, and the issuing country records the grounds it relied on in your file.
  • It is not for people who simply forgot to apply. The ordinary application will be an online form with a €20 fee, waived for under-18s and over-70s. See how the ETIAS application will work.

What should travellers do now?

Nothing, other than knowing the route exists. If you have a past refusal or a record that could trigger one, our criminal record guide explains what the application will ask. For the current launch position, see ETIAS status. Do not pay anyone who offers an “emergency ETIAS” today: none exists, and our scam guide shows what those offers look like.
