ETIAS abuse form: what it covers and what it doesn’t
The EU is building a form to report abuse by commercial ETIAS intermediaries. It covers four named practices, but it is not a refund route, an appeal or a scam-site hotline.
The EU has a page called “Report abuse” on its ETIAS site. It is not a place to report any website that looks fake. It is for complaints about commercial intermediaries who applied for ETIAS on your behalf. ETIAS is not open, so there is nothing to report yet, and the page itself says you “will be able to report it on this website” once the system runs.
What does the EU’s “Report abuse” page say?
The page warns of “possible abusive and fraudulent practices by commercial intermediaries” and lists four forms they can take:
- Misleading applicants into believing the intermediary’s site is the official channel, so the extra fee looks like part of the application.
- Fraudulent use of the personal or financial data you provided.
- Charging an unreasonably high price for the service.
- Failing to submit the application in the required time, format and quality.
The same four examples appear in the recitals of Commission Implementing Regulation (EU) 2021/331, which set up the form. The regulation notes that comparable travel-authorisation systems have seen exactly this behaviour.
Who is an intermediary, and is using one legal?
Yes, it is legal. Article 15(4) of the ETIAS Regulation says an application may be submitted “by the applicant or by a person or a commercial intermediary authorised by the applicant”. A paid service that fills in the form for you is a commercial intermediary. What the law targets is deception and poor service, not the existence of paid help. The official fee is €20, and anything a service charges on top should be shown as its own fee. The guide to applying for someone else covers the declaration of representation.
What the form is not for
Three limits matter. They come from the implementing regulation, and the first is repeated on the EU page.
- It does not fix your case. The page says the reporting “is not intended to provide remedies in individual cases and is not a substitute for the pursuit of any claims” under national law. Refunds and chargebacks are for your card provider or national consumer authority.
- It is not an appeal. The regulation says the form “does not constitute a channel for appealing decisions on applications”. A refusal goes through the appeal process instead.
- It should not hold personal data. Before submitting, applicants must confirm they understand they should not put personal data in the report.
What happens to a report?
Under the implementing regulation, a submitted form goes automatically to the ETIAS Central Unit, which is established within the European Border and Coast Guard Agency (Frontex). You get an on-screen acknowledgement with the date and time, and you can save or print it. The Central Unit must monitor, process and analyse all reports and publish information to prevent abuse. Once a year it gives the Commission an anonymised report on cases, similarities, recurrences and trends. The point is pattern-spotting and better public information, not individual enforcement.
What to do now if a site is already asking for money
Do not pay for an ETIAS application today. Applications are not open, and the official EU ETIAS site says so on its front page. A site selling one now is not an intermediary submitting your application. It has nothing to submit it to. If you have already paid, our guide to fake ETIAS websites already taking money covers the steps, and the ETIAS scams page lists the warning signs. No action is required yet. Applications are not open.
ETIAS Pro is a private information service, not the EU or any government body. Check our own status on the is ETIAS Pro official page, and for the current position on launch, see the ETIAS status page.
